These terms and conditions apply to the sale of products (specifically the “Into the Lion’s Den” Calendar) by us to you via this website. By using this site and/or shopping with us, you are agreeing to these terms and conditions. Please ensure you read them carefully before using this website and/or ordering from us.

1. Information about us

This website is operated by Walterton and Elgin Community Homes (“WECH”).

Fulfillment partner: Please note that order fulfillment, packing, and shipping are managed on our behalf by LUV. By placing an order, you acknowledge that your delivery details will be shared with LUV solely for the purpose of managing delivery and or returns of your goods.

2. The contract

2.1 Order Acceptance: Your order is an offer to buy. Our acceptance of your order takes place when we email you to confirm the goods have been dispatched. The contract is formed at that moment.

2.2 Availability: All products are subject to availability. If we cannot supply a calendar due to stock issues, we will inform you immediately and you will not be charged (or will be refunded immediately).

3. Price and payment

3.1 Pricing: The price of the calendar is as quoted on the website.

3.2 VAT: Prices include VAT (where applicable) unless otherwise stated.

3.3 Delivery Costs: Delivery charges are shown at checkout based on your location and the shipping method selected.

4. Delivery

4.1 Timescales: We aim to dispatch orders within 48 hours, using Royal Mail 1st class which aims to arrive within the next day. Delivery estimates provided are guides and not guarantees.

4.2 Risk: The product becomes your responsibility from the time we deliver the product to the address you gave us.

4.3 Shipping Delays: Bank holidays and weekends are not counted as working days, severe weather may cause postal delays, peak periods (e.g. Christmas) may extend delivery times

4.4 Damaged or Lost Items: Report damaged items as soon as possible after delivery. For lost items, please wait up to 10 working days after dispatch notice before reporting, we’ll arrange replacement or refund for lost/damaged items.

5. Returns and refunds

We want you to be happy with your purchase. Our returns policy distinguishes between “Your Right to Change Your Mind” and “Defective Items.”

Buyer fault (Change of Mind / No Longer Wanted). If you simply change your mind, ordered by mistake, or no longer want the item:

  • Timeframe: You have 30 days from the date of delivery to return the item to us.
  • Condition: The calendar must be unused, in its original condition, and in its original packaging (shrink-wrap intact if applicable).
  • Return Shipping Cost: You (the Buyer) are responsible for the cost of returning the item to us.
  • Refund: Once we receive the item, we will refund the price of the item only. We do not refund the original shipping costs for international orders or expedited shipping (Standard UK outbound shipping may be refunded in accordance with UK Statutory rights if the return is requested within 14 days).

Seller fault (Defective, Damaged, or Wrong Item). If the item arrives damaged, is defective, or is not what you ordered:

  • Timeframe: You must notify us within 30 days of receipt.
  • Return Shipping Cost: We (the Seller) will pay the return shipping costs. We may provide a pre-paid label or reimburse your postage costs upon receipt of the proof of postage.
  • Refund: You are entitled to a full refund, including the price of the item and your original outbound delivery charges. Alternatively, you may request a free replacement.

6. How to return an item

To initiate a return, please contact us using our online form with your Order Number and the reason for the return.

7. Liability

7.1 Losses: We are not liable for business losses. We only supply the products for domestic and private use.

7.2 Force Majeure: We will not be liable or responsible for any failure to perform or delay our performance in any of our obligations under these terms that is caused by events outside of our reasonable control (“Force Majeure”). A Force Majeure Event includes any act, event, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes or other industrial action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
  • Fire, explosion, storm, flooding or other natural disasters;
  • Forced inability to use railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Forced inability to use public or private telecommunications networks;
  • The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use reasonable endeavours to find a solution by which our obligations under these Terms and Conditions may be performed despite the Force Majeure Event.

8. Personal data

We will use your personal information only as set out in our Privacy Policy. As noted, your name and address are shared with our fulfilment partner, LUV, strictly for delivery and return purposes.

9. Intellectual property and rights to use

All content and intellectual property rights contained within this website, including, but not limited to, registered trade marks, imagery, graphics and editorial content, are the property or licensed use of WECH. Permission to use this material must be obtained in writing from us. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on WECH’s products or the Into the Lion’s Den brand.

9. Governing law

These Terms and Conditions and any separate agreements whereby we provide you products and services shall be governed by and construed in accordance with English law. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
